Overview
The Department of Vermont Health Access (DVHA) is seeking applications from attorneys or graduating law students to join its legal team as a Staff Attorney.
DVHA administers Vermont's Medicaid program as well as Vermont's state-based health insurance exchange under the Affordable Care Act. DVHA's mission is to improve Vermonters' health and well-being by providing access to high-quality, cost-effective health care. As a staff attorney in DVHA's legal unit, you will help DVHA tackle challenges and execute its mission by providing timely, accurate legal advice in collaboration with a team of other attorneys within DVHA and across Vermont's Agency of Human Services.
DVHA's legal unit advises the department about a wide range of issues, including:
- State and federal Medicaid law and policy;
- Public records act compliance and record maintenance;
- Civil rights and nondiscrimination in health care;
- Health information privacy, including HIPAA, Part 2, and state-based exchange privacy rules;
- Administrative law, including rulemaking and due process in contested cases;
- Contract and grant reviews; and
- Legislation review and drafting.
DVHA encourages attorneys or graduating law students of any level of experience to apply for this position. Under the State of Vermont Attorney Pay Plan, this position can be identified as a Staff Attorney I (0-2 years' experience); Staff Attorney II (2-5 years' experience); Staff Attorney III (5-8 years' experience); or Staff Attorney IV (8+ years' experience). Graduating law students who have not passed the bar in any state will initially be hired as law clerks until they achieve Vermont bar licensure.

AHS BACKGROUND CHECKS: Candidates must pass any level of background investigation applicable to the position. Minimum RequirementsAdmission to the Vermont Bar, eligibility for admission by waiver, or pending admission to the Vermont Bar.
Preferred QualificationsJuris Doctor (J.D.) degree from an accredited law school.
Proven ability to develop, interpret, and implement policies and procedures in highly regulated fields in compliance with state and federal law.
Knowledge of legal and policy issues relevant to state Medicaid agencies or health insurance generally.
Familiarity with public records rules and procedures.
Written and oral communication skills, with an ability to provide clear and practical legal guidance to non-legal audiences.
Understanding of the role of an organizational attorney.
